Certification in the forensic speciality “examination of patented subject matter” is a formal requirement — without it the opinion can be challenged on procedure alone.
The court frames the questions for the expert, but preparing correct wording is the parties' job. An imprecise question produces an answer that settles nothing on the merits, and a second examination is not always granted.
